Court sets judgment in Abba Kyari asset-declaration case for February 26, 2026

The Federal High Court sitting in Abuja has scheduled February 26, 2026, for judgment in the case filed by the National Drug Law Enforcement Agency (NDLEA) against suspended Deputy Commissioner of Police, Abba Kyari.

Justice James Omotosho fixed the date on Friday after the adoption of final written addresses by NDLEA counsel Sunday Joseph, Kyari’s lead counsel Onyechi Ikpeazu (SAN), and Monjok Agom, who represented Kyari’s two brothers.

Kyari, a former commander of the Police Intelligence Response Team (IRT), is being prosecuted alongside his younger brothers, Mohammed and Ali, for allegedly failing to fully declare their assets.

The NDLEA alleged it traced 14 properties to Kyari, including shopping malls, residential estates, farmlands, plots of land in Abuja and Maiduguri, and a polo playground.

The agency also claims to have discovered over N207 million and €17,598 in several bank accounts belonging to Kyari across GTBank, UBA, and Sterling Bank.

According to the NDLEA, the defendants concealed ownership of properties and converted funds in violation of the NDLEA Act and the Money Laundering (Prohibition) Act, 2011.

All defendants pleaded not guilty. The prosecution presented 10 witnesses and tendered more than 20 exhibits. After closing its case, Kyari filed a no-case submission—an application Justice Omotosho dismissed on October 28, ruling that the prosecution had established a prima facie case.

Kyari opened his defence on November 4, maintaining that he properly declared his assets and those of his wife. He denied ownership of several properties listed by the NDLEA, insisting some belonged to his late father, and refuted claims that he owned a polo ground in Borno State.

He concluded his defence on November 26, 2025, while his brothers opted not to call witnesses. The court clarified that this asset-declaration case is separate from Kyari’s ongoing narcotics-related trial before another judge of the Federal High Court in Abuja.
