A Federal High Court sitting in Abuja, has struck out an application for stay of execution of his judgement which had on the 8th of this month, ordered the removal of Governor David Umahi of Ebonyi State and his deputy, Kelechi Igwe from office.
The Judge, Justice Inyang Ekwo struck out the application following its withdrawal by counsel to the governor and his deputy, Chief Chukwuma Machukwu Umeh.
Chief Umeh told the court that since a notice of appeal had been entered, the appellate court is seized of the matter.
Meanwhile, based on the information from Chief Umeh and having tendered the certify true copy of records from the Bar showing that an appeal had been properly entered at the Court of Appeal, Justice Ekwo struck out the application seeking the stay of execution of the judgement which had sacked Governor Umahi and his deputy, from office.
Similarly, the application for stay of execution of the judgement that sacked the 16 APC Lawmakers who defected from the PDP was struck out since the court was convinced that an appeal has been filed.
