President Bola Ahmed Tinubu has signed the necessary instruments to formally exercise his constitutional powers of prerogative of mercy, granting pardon and clemency to selected individuals previously convicted of various offences.
After extensive consultations with the Council of State and consideration of public opinion, the President ordered a further review of the initial list of recommended beneficiaries.
This review was carried out in line with his discretionary powers under Section 175 (1) and (2) of the 1999 Constitution (as amended).
As a result, individuals convicted of serious crimes, including kidnapping, drug-related offences, human trafficking, fraud, and illegal possession or dealing in firearms, were removed from the list. Some others who had earlier received full pardons had their sentences instead commuted.
According to the Presidency, this decision was driven by the gravity and security implications of certain offences, the need to respect the rights and emotions of victims, support law enforcement morale, and uphold Nigeria’s international obligations.
The review also reflected the principle of justice as a three-way responsibility involving the accused, the victim, and the society.
The final approved list of eligible beneficiaries has been forwarded to the Nigerian Correctional Service for implementation in accordance with the signed instruments of release.
To enhance transparency and accountability in future exercises, President Tinubu also directed the immediate relocation of the Secretariat of the Presidential Advisory Committee on Prerogative of Mercy from the Federal Ministry of Special Duties to the Federal Ministry of Justice.
Additionally, the President has instructed the Attorney-General of the Federation to develop clear Guidelines for the Exercise of the Power of Prerogative of Mercy.
These guidelines will mandate consultation with relevant prosecuting agencies to ensure that only individuals who meet the stipulated legal and procedural requirements benefit from such clemency in the future.
President Tinubu expressed appreciation for the constructive feedback from stakeholders and the public, reaffirming his administration’s broader commitment to judicial reforms and the enhancement of justice delivery in Nigeria.
